ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to survey and measure the petitioner's lands comprised in Survey Nos.316/8, 318/2B, 318/5, 318/6 2. The petitioner claims title to the properties comprised in Survey Nos. 316/8, 318/2B, 318/5 and 318/6. The said properties were purchased by the petitioner's father under a registered Sale Deed bearing Document No. 1319 of 1979. The vendor of the petitioner's father had stated in the said Sale Deed that the property was originally held jointly 2/6 https://www.mhc.tn.gov.in/judis and upon partition, the same had fallen to the vendor's share. Thereafter, the petitioner's father was in peaceful possession and enjoyment of the properties. The petitioner's father died on 28.09.2022 and the petitioner being his only son, is now in possession and cultivation of the subject properties. The lands are covered under Joint Patta No. 7711 standing in the names of the petitioner's father, namely, Velu, S/o. Veeran and Kadhar Sahib Rowther, S/o. Mohamed Sultan Rowther. The petitioner now seeks a survey of the subject properties, as the fourth respondent, who is the owner of the adjacent land is allegedly disputing the boundary and interfering with the petitioner's peaceful possession. Hence, the petitioner seeks a direction to the competent authority to conduct a survey of the subject properties. 3. Heard both sides and perused the materials available on record. 4. In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner, fourth respondent and the petitioner's mother and his 3/6 https://www.mhc.tn.gov.in/judis siblings and any rival claimants, if any. If the first respondent requires police protection, the same shall be provided by the third respondent police. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 5. With the above observations, this Writ Petition is disposed of.
