1. Pursuant to the order dated 9th March, 2026, a report in the form of an affidavit has been filed by the Sub- Assistant Engineer of Nabadwip Municipality. The Sub- Assistant Engineer is personally present in Court today and would submit that inadvertently he had noted in his report dated 27th February, 2026 that there was no grill on the front side of LR No.5265 (corresponding to RS Plot No.2817). According to him, he had no intention to mislead this Court, there had however been an inadvertent error in his report dated 27th February,
2026. Today, he acknowledges the fact that there is, in fact, a grill which contains 5 hatch bolt gates for ingress and egress to the open spaces of LR plot no.5265. It
2 appears that certain explanations have been given by him as to why such gate has been installed. He would, however, submit that the municipality has not installed such gate. He, however, tenders his unqualified apology and prays for pardon.
2. Having heard the learned advocates appearing for the respective parties and having considered the explanations provided by the S.A.E., I am of the view that the matter against SAE, need not be proceed further. However, he should be warned against any future repeat conduct in this regard.
3. Insofar as the petitioner is concerned, the municipality shall ensure that the ingress and egress of the petitioner to his residence shall not be interfered with and the aforesaid iron gate, which has been installed and interferes with the ingress and egress of the petitioner cannot be retained and the same shall be removed within 4 weeks once, the Annapurna Puja is over.
4. With the aforesaid observations and directions, the instant writ petition is disposed of.
5. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
