JUSTICE BIPIN GUPTA Judgment / Order 10/04/2026 In S.B. Civil First Appeal No. 424/2017:- 1. The matter comes upon an Application No. 1/2026 filed by the plaintiff-appellant, wherein it is stated that the parties have entered into a compromise and a full and final settlement has been reached between them. Accordingly, the appellant prays that the appeal be permitted to be withdrawn, and that the Court fees paid in relation to the appeal be ordered to be refunded back. 2. Learned counsel for the respondent does not dispute the fact that a compromise has been entered into between the parties to their mutual satisfaction. Furthermore, the respondent's counsel has no objection to the refund of the Court fees paid by the appellant in the appeal. 3. Heard and perused the material available on record. 4. This Court finds that both parties have agreed and stated that a compromise has been entered into, and accordingly, the appeal may be permitted to be withdrawn. For the reasons stated above, the appellant is permitted to withdraw the appeal. 5. This Court further finds that the Hon'ble Supreme Court, in [2026:RJ-JP:15244] (3 of 3) [CFA-424/2017] Special Leave Petition Nos. 3063-3064/2021, decided on 17.02.2021, held that not only agreements made through Lok Adalat or other Court-approved modes but also private settlements of disputes outside the Court are valid. In such cases, the Court fees paid may be ordered to be refunded. 6. In light of the above judgment, this Court deems it appropriate that the Court fees paid by the appellant in this appeal be refunded to the appellant in accordance with the law. 7. With the aforesaid observations, the present Civil First Appeal is hereby dismissed as withdrawn. 8. Pending applications, if any, also stand disposed of. In S.B. Civil First Appeal No. 410/2017 :- 1. Learned counsel for the appellant seeks permission to withdraw the present first appeal as the compromise has been arrived between the parties. 2.
