Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents 1 to 3 to survey the petitioner's land in S.F.Nos. 298/8, 298/11 and 298/16 in Patta Nos. 2313, 2316 situated at Melakallampatti, Nagarappatti Post, Ponnamaravathi Taluk, Pudukkottai District along with police protection, on the basis of the petitioner's representation dated on 29.05.2026.
ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to survey the petitioner's land in S.F.Nos. 298/8, 298/11 and 298/16 in Patta Nos. 2313, 2316. 2. The petitioner claims title to the property in Survey Field Nos. 298/8, 298/11, and 298/16. The petitioner's wife purchased the said properties from one Raja and Vellaiammal under registered Sale Deeds bearing Document No. 5288 of 2024, dated 13.12.2024 and Document No. 219 of 2025, dated 21.01.2025. It is the petitioner's case that Raja and Vellaiammal are the legal heirs of one Andiappan, who died on 24.02.1999 and that they sold the property to the petitioner's wife. the petitioner traces title to the subject property through the aforesaid sale deeds. The petitioner now seeks a survey of the property, as the fourth respondent is disputing the boundary and interfering with the petitioner's possession. Hence, the petitioner seeks a direction to the competent authority to conduct a survey of the subject property. 3. Heard both sides and perused the materials available on records. 4. In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner, fourth respondent and any rival claimants, if any. If the first respondent requires police protection, the same shall be provided by the third respondent police. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is disposed of.
