Mr. Vikas Kumar Guglani, learned counsel for the petitioners in WPCRL No. 659 of 2026 and learned counsel for the complainant in WPCRL No. 660 of 2026. 2. Mr. Lalit Sharma and Mr. Abhishek Joshi, learned counsel for the petitioners in WPCRL No. 660 of 2026 and learned counsel for the complainant in WPCRL No. 659 of 2026. 3. Mr. Tumul Nainwal, learned A.G.A. for the State. 4. These two writ petitions have been moved by the petitioners along with the compounding applications for quashing of First Information Report dated 11.06.2025 bearing FIR No. 0034 of 2025, P.S. Buggawala District Haridwar as well as the cross First Information Report dated 25.06.2025 bearing FIR No. 0037 of 2025 P.S. Buggawala District Haridwar. 5. The first FIR is challenged in WPCRL No. 659 of 2026 and the cross FIR is challenged in WPCRL No. 660 of 2026. The petitioners of both the petitions and the respondent/complainant of both the FIRs are present in Court except one Mr. Babli Rana, who is the petitioner no.6 in WPCRL No. 660 of 2026 since he is bed ridden suffering from paralysis. Smt. Bebi @ Khekhi petitioner no. 6 in WPCRL No. 659 of 2026 is not present since she is not well, however, her husband is present in Court and also identified by his counsel. 2026:UHC:3526 6. The medical report of Mr. Babli Rana is also placed before this Court and the same is taken on record. Those, who are present in Court are identified by their counsels. Mr. Babli Rana who is not present also identified. 7. It is argued by learned counsel for the parties that all of them now have settled their disputes and the complainant of both the FIRs does not want to pursue their respective FIRs. It is further contended that their relations are cordial. 8. It is also argued by the learned counsel for the parties that all the offences are compoundable except the offence punishable under Section 191(3) of BNS 2023. 9. On the other side, Mr. Tumul Nainwal, the learned AGA, on instructions, apprise to this Court that in one of the FIR i.e. FIR No. 0034 of 2025, the investigation is still going on, however, in another FIR the investigation has been completed and the charge sheet has been placed before the P.O. concerned, but up till date the cognizance has not been taken. 10. At this juncture, the counsel for both the parties submits that there are three persons who are licence holder, namely, Mr. Mukesh Kumar, Mr. Sachin Kumar and Mr. Babli Rana and on their own desire they are ready to pay a cost of Rs. 3,00,000/- in the Advocate Welfare Fund within 15 days and will file the receipt in this regard on record. 11. Mr. Tumul Nainwal, learned AGA also submits that one of the offence punishable under Section 191(3) of BNS 2023 is not compoundable but with the leave of the Court this offence can also be compounded. 12. After hearing the arguments of learned counsel for the parties and taking into consideration that the parties have settled their disputes and all the offences are compoundable except one i.e. Section 191(3) of BNS 2023, and further taking into 2026:UHC:3526 consideration that the complainant of both the FIRs not want to continue with the impugned FIRs, therefore, there is no useful purpose to continue with the investigation and as such, this Court is of the view that both the writ petition as well as the compounding application are liable to be allowed. 13. Accordingly, both the writ petitions as well as the compounding applications are allowed and the impugned First Information Report dated 11.06.2025 bearing FIR No. 0034 of 2025, P.S. Buggawala District Haridwar as well as the cross First Information Report dated 25.06.2025 bearing FIR No. 0037 of 2025 P.S. Buggawala District Haridwar are hereby quashed.
