Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents 1 to 3 to survey the petitioners Punja land in UDR Patta No.7763 in Survey 640-6A5 measuring about 0.01.00 Ares 2 cents including RCC terrace shed and house measuring about 90 sq.mt. situated in Door No. 145C, Tax Receipt No.565 in P.Usilampatti Vegupatti Post, Ponnamaravathy Taluk, Pudukkottai District along with police protection.
ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to survey the petitioner's Punja land in UDR Patta No.7763 in Survey 640-6A5 measuring about 0.01.00 Ares 2 cents including RCC terrace shed and house measuring about 90 sq.mt. situated in Door No.145C, Tax Receipt No.565 in P.Usilampatti Vegupatti Post, Ponnamaravathy Taluk, Pudukkottai District along with police protection.
2. The petitioner claims title to the property based on the Gift Settlement Deed executed by her husband, namely, Ramasamy, in her favour, registered as Document No. 369 of 2026, dated 27.01.2026. 2/6 https://www.mhc.tn.gov.in/judis
Pursuant thereto, a UDR patta has been issued in favour of the petitioner. The petitioner's husband traces his title to the property based on the UDR patta. The petitioner now seeks a survey of the property, as the fourth respondent has raised a dispute with regard to the boundary.
3. In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner, fourth respondent and any rival claimants, if any. If the first respondent requires police protection, the same shall be provided by the third respondent police. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. 3/6 https://www.mhc.tn.gov.in/judis
• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 4.With the above observations, this Writ Petition is disposed of.
