This appeal is directed against the order dated 28.01.2026 passed by the learned Additional Sessions Judge-V, Giridih in BP No. 33/2026, arising out of Gandey PS Case No. 63 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the house of one Shayar Ali was searched by the police and huge quantity of arms and ammunitions as well as instruments for manufacturing illegal arms were recovered. Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 20.11.2025. It has further been submitted that the appellant is merely an arms mechanic and in fact, the main allegation has been levelled against Shayar Ali who was owning the premises. Learned A.P.P. has opposed the prayer for bail of the appellant. It appears that from the premises of Shayar Ali from where the appellant was also apprehended, large number of arms and ammunitions as well as the instruments used for manufacturing arms and ammunitions were also seized. The appellant has two antecedents relating to Arms Act in the district of Khagaria as well as in the district of Munger in Bihar. Regard being had to the fact that a gun factory was having run by the appellant and other accused persons, we are not inclined to interfere in the order dated 28.01.2026 passed by the learned Additional Sessions Judge-V, Giridih in BP No. 33/2026, arising out of Gandey PS Case No. 63 of 2025 and consequently, we dismiss this appeal, at this stage.
