ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 24.10.2025 for the offences punishable under Sections 8(c) r/w. 20(b)(ii)(C), 29(1) of NDPS Act, in Crime No.11 of 2025 on the file of the 1/8 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.15376 of 2026 respondent police, seeks bail. 2. The case of the prosecution is that the on 24.05.2025, at about 15.00 hours, based on the prior information the police party went to the place of occurrence, namely near the Tasmac of Spenser compound Road, at Dindigul, Bust Stop and identified the accused persons, surrounded and recovered 24 kilograms of ganja. Further it is stated that all were in conscious possession. Hence, all were arrested. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submitted that in the FIR 6 persons were added initially. Later on the basis of the statement made by the arrested accused other persons were impleaded in this case. It is also stated that on seeing the police party, some of the accused were ran away from the scene of occurrence. There is no material to implicate this petitioner except the confession statement of the co-accused. The co- accused namely A1 to A3 were also granted bail by this Court in Crl.O.P. (MD).Nos.21452 of 2025, 10520 of 2026 and 9741 of 2026. The petitioner is in custody from 24.10.2025 and ready to abide any condition imposed by this 2/8 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.15376 of 2026 Court. Hence, he prayed bail for the petitioner. 4. The learned Counsel appearing for the State reiterated the prosecution case and reported that the petitioner is the main accused in this case. The quantity involved in this case is commercial quantity. Hence, Section 37 of the NDPS Act is applicable to the case of the petitioner. The petitioner was also awaiting in the place of occurrence for trafficking the ganja. On seeing the police officials he ran away from the place of occurrence. He also in conscious possession of ganja. Investigation in this case is still pending. Hence, he prays to dismiss this application. 5. This Court heard both sides and perused the materials available on record. 6.
While considering the bail applications of co-accused namely Prakash in Crl.O.P.(MD).No.21452 of 2025, Ganesh Pandi in Crl.O.P.(MD).No.10520 of 2026 and Manikandan in Crl.O.P.(MD).No.9741 of 2026, this Court has observed as follows:

“6.Considering the rival submissions made by the

Crl.O.P.(MD)No.15376 of 2026 that based on the confession statement given by the co- accused this petitioner has been implicated as an accused and also the fact that no contraband was recovered from this petitioner and though the petitioner has some previous cases those cases are not for similar kind of offences and also taking into consideration the period of incarceration suffered by the petitioner, this Court is inclined to grant bail to the petitioner subject to the following conditions:” Crl.O.P.(MD).No.10520 of 20256
“6. Considering the rival submissions made by the
learned counsel on either side, nature of offence, and though as per prosecution, the quantity of contraband involved in this case is a commercial quantity, the contraband were recovered through separate mahazar from different persons in public place and the same has been clubbed together and treated as commercial quantity. As far as this petitioner is concerned, the alleged contraband recovered from him is 6 kgs and the same is not a commercial quantity. Considering further that the petitioner has been granted bail in the previous cases registered against him as well as the period of incarceration undergone by the petitioner and stage of completion of investigation, this Court is inclined to grant bail to the petitioner subject to the following conditions: :” 4/8 https://www.mhc.tn.gov.in/judis

“6. Considering the rival submissions made by the
learned counsel on either side, the nature of the offence and though the prosecution stated that the quantity of contraband involved in this case is a commercial quantity, the contraband was recovered from different persons through separate mahazar and the same has been clubbed together and as far as this petitioner is concerned, the alleged contraband recovered is 6 kgs and the same is not a commercial quantity and no previous case is pending against the petitioner and the investigation has been completed and charge sheet is made ready and the co-accused was arrested and released on bail and also considering the period of incarceration undergone by the petitioner from 25.05.2025, this Court is inclined to grant bail to the petitioner subject to the following conditions: “
7. The reason stated by this Court for the granting bail to the co-accused is also applicable to this petitioner is also. There is no recovery from this petitioner. Accordingly, considering the period of incarceration, I am inclined to grant bail to the petitioner subject to certain conditions.
[a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.25,000/- (Rupees 5/8 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.15376 of 2026 Twenty Five only) with two sureties each for a like sum to the satisfaction of the learned I Additional District Judge, Special Court for NDPS Act Cases, Madurai, and on further conditions that: [b] the petitioner shall report before the learned I Additional District Judge, Special Court for NDPS Act Cases, Madurai, at 10.30 a.m., and 5.00 p.m., on all working days, until further orders; [c] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions 6/8 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD)No.15376 of 2026 have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS. (K R S J)
