1. The instant bail application has been filed under Section 483 of BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.48/2026 registered at Police Station Bhiwadi Phase Trithia, District Bhiwadi for the offence(s) under Sections 308(2), 351(3) of BNS and the learned Trial Court amidst the offences under Sections 308(2), 351(3) of BNS dismissed the bail application before it.

Learned counsel for the accused-applicant submits that the applicant is a young person, aged 24 years and that the applicant is behind bars ever since 13.02.2026. It is submitted that the applicant is not having any criminal antecedents. It is further submitted that the informant and the other affected persons have lodged the present FIR, wherein the false allegations of
[2026:RJ-JP:9803] (2 of 2) [CRLMB-3271/2026] demanding an amount to the tune of Rs. 5000/- were levelled against the applicant. Moreover, it is submitted that a compromise in regard of the aforesaid has entered inter se the parties.
3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application.
4. However, learned counsel for the complainant has not disputed the above said contentions and has accepted the fact of compromise entered inter se the parties.

Having heard the arguments advanced by learned counsel for the parties, considering that the applicant is a young person, aged 24 years; that the applicant is behind bars ever since 13.02.2026; that the parties have entered into a compromise by way of the affidavits; that there are no criminal antecedents registered against the applicant and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.

Accordingly, the present bail application under Section 483 of BNSS is allowed and it is ordered that accused-applicant Omprakash S/o Kasmira, shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
