PUBLIC PROSECUTOR The Court made the following: ORDER: The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioner / Accused No.5, in connection with Crime No.1229 of 2022 on the file of Nallapadu Police Station, Guntur registered for the offence under Section 307 read with 34 IPC. 2. Heard Sri Md.Saleem, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for Respondent / State. 2 3. Learned counsel for the Petitioner would submit that the Petitioner is innocent of the alleged offence. Learned counsel would further submit that the allegations made in the report do not disclose any specific overt acts against the Petitioner and he was falsely implicated. It is further submitted that there are no criminal antecedents against the Petitioner. Learned counsel would further submit that the other Accused were granted regular bail in this case. Hence, prayed to grant anticipatory bail to the Petitioner. 4. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor vehemently opposed the petition and would submit that there are specific allegations against the Petitioner with regard to the commission of the alleged offence. It is further submitted that no case is made out to grant anticipatory bail to the Petitioner at this stage. 5. Considering the nature of the allegations and the specific accusations made against the Petitioner, this Court is of the view that it is not a fit case to exercise discretion in favour of the Petitioner at this stage. 6. In the result, the Criminal Petition is dismissed. The Petitioner is at liberty to surrender before the concerned Court within one week from this day and move regular bail application. On filing such application, the learned Judge may pass appropriate order as expeditiously as possible in accordance with law.
