The case of the petitioner is that an online application was submitted on 10.06.2026 requesting the official respondents to conduct and complete the survey pursuant to the online application submitted by the petitioner dated 10.06.2026 by measuring the property in Survey Nos.596/1, 596/2 and 596/3 of Kangeyanpalayam Village in Dharapuram Taluk of Tiruppur District and fixing the boundaries and boundary stones of the same, with necessary police protection from the 5th respondent. However, the same has not been considered till date. Challenging the inaction on the part of the official respondents, the petitioner is constrained to file the present Writ Petition. __________ Page3 of 7 https://www.mhc.tn.gov.in/judis WP No. 28586 of 2026 3. In response, Mr. B. Pachaiyappan, learned Government Counsel, submitted that the application of the petitioner dated 10.06.2026 would be considered by respondents 3 and 4, who are the competent authorities. He further submitted that appropriate orders would be passed on merits and in accordance with law, after issuing notice to the private respondents. 4. In view of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs respondents 3 and 4 to consider the petitioner's application dated 10.06.2026 on merits and in accordance with law. The respondents 3 and 4 shall conduct a survey of the subject property comprised in Survey Nos. 596/1, 596/2, and 596/3 of Kangeyanpalayam Village, Dharapuram Taluk, Tiruppur District, and fix the boundary stones within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner, adjacent landowners/neighbours, the private respondents, and interested parties, if any. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 5th respondent / jurisdictional Police, and the 5th respondent Police are mandated to provide __________ Page4 of 7 https://www.mhc.tn.gov.in/judis WP No. 28586 of 2026 necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
