2026:UHC:3812 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS W PSS/ 4 5 / 2 0 2 6 Hon’ble Manoj Kumar Tiwari, J. Mr. Harsh Vardhan, Advocate for the petitioner. Mr. Ganga Singh Negi, Additional Chief Standing Counsel for the State. Mr. Rajendra Arya, Advocate holding brief of Mr. Neeraj Garg, Advocate for the UPNL. 2. Petitioner was engaged as driver through outsourcing agency, namely, UPNL in Labour Court, Kashipur. His engagement has been discontinued vide order dated 11.12.2025 which is under challenge in this writ petition. 3. The impugned order is on record as Annexure-1 to the writ petition. Perusal thereof reveals that petitioner’s engagement was discontinued as the only Government vehicle provided to Labour Court was condemned on 16.03.2023, and thereafter new vehicle was not provided to the Labour Court. In the absence of any vehicle, petitioner had become surplus. 4. Learned counsel for the petitioner submits that petitioner has been serving in Labour Court since 2012, therefore his engagement could not have been abruptly discontinued, and if work is not available in Labour Court, then petitioner can be accommodated in some other government 2026:UHC:3812 department. 5. Mr. Rajendra Arya, learned counsel holding brief of Mr. Neeraj Garg, learned counsel for UPNL submits that name of the petitioner shall be recommended to any government/semi- government organisation wherever work and post of driver is available. 6. The writ petition is, accordingly, disposed of with a direction to respondent No. 4 to recommend name of the petitioner for engagement through outsourcing in any other government /semi-government organisation where requirement of a driver is there. 7. Needful be done within four weeks. (Manoj Kumar Tiwari, J.) 18.05.2026 Mahinder/
