Shri Shubhr Rastogi, learned counsel for the petitioner, at the outset, states that there are certain mistakes in the writ petition and, therefore, he may be permitted to withdraw the writ petition with liberty to file fresh writ petition. 2. Learned counsel for the private respondent submits that one Telu Ram filed WPMB No.357 of 2026 for restraining private respondents from carrying on mining activities and the said writ petition was got dismissed as withdrawn. Thus, according to him, the present petition is a motivated one. 3. As there is request for withdrawal of the writ petition, therefore, we are not examining the merits of the submission made by learned counsel for respondent no.6. 1 2026:UHC:3957-DB In case any fresh petition is filed, it shall be open to respondent no.6 to contest the same on all possible pleas. 4. The writ petition is dismissed as withdrawn with liberty to file fresh petition or avail such other remedy as may be advised. 5. Pending application, if any, also stands disposed of.
