By means of the present writ petition, the petitioner seeks a direction to respondent nos. 1, 2 and 3 to extend adequate protection to the petitioner against any illegal interference, harassment or intimidation at the hands of the private respondents as well as the police officials of Police Chowki Bailparao, Police Station Kaladhungi, District Nainital. 3. Learned counsel for the petitioner submits that the petitioner is in settled possession of agricultural land comprised in Khata No. 119, Khet Nos. 597 and 598, situated at Village Belparao, Tehsil Kaladhungi, District Nainital. It is further submitted that the petitioner has instituted a declaration suit before the Assistant Collector, First Class, Kaladhungi, District Nainital, wherein the petitioner’s application under Section 229-D has been allowed and the learned Assistant Collector has directed that no third-party interest shall be created in respect of the suit property. 4. It is contended by learned counsel for the petitioner that despite the aforesaid order passed under Section 229-D in favour of the petitioner, the Station House Officer, Police Chowki Bailparao, Police Station Kaladhungi, District Nainital, in connivance with respondent nos. 6 to 12, is unlawfully interfering with the petitioner’s peaceful possession and is creating hindrances in the petitioner’s normal agricultural operations 2026:UHC:632 over the aforesaid land. 5. Since the matter is sub judice before the competent court and an order under Section 229-D has already been passed in favour of the petitioner, the present writ petition is disposed of with a direction to the respondents to ensure that the petitioner is permitted to carry on his agricultural activities over the subject land strictly in accordance with law, without any illegal interference.
