By way of filing this writ petition under Article 226 of the Constitution of India, the petitioner seeks a limited relief for disposal of his appeal filed before the appellate authority/Regional Director, Employees’ State Insurance Corporation Ltd., against the order order dated 15.5.2023 (Annexure-P/5) passed by Assistant Director/respondent No.3. Learned counsel for the petitioner submits that the appeal has been filed by the petitioner against the order passed by respondent No.3/Assistant Director under Section 45AA of the Employees State Insurance Act, 1948. He further submits that he has annexed the copy of memo of appeal as Annexure-P/6 dated 24.8.2023 and submits that the appeal has been filed before the appellate authority on 24.8.2023, but till date the same has not been decided. Hence, it is prayed that this petition may be disposed of directing respondent No.2/appellate authority to decide the appeal filed by the petitioner within stipulated period. 3. Learned counsel for the respondents 1 to 4 submits that the appeal filed by the petitioner is under consideration and the same shall be decided at the earliest. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the contention put forth by the parties and also considering the limited prayer of the petitioner, this petition is disposed of at this stage, directing respondent No.2/appellate authority to decide the appeal filed by the petitioner under Section 45AA of the Employees State Insurance Act, 1948, as early as possible, preferably within a period of 60 days from the date of receipt of a copy of this order. The petitioner is also directed to cooperate with the appellate authority. 6. With aforesaid observation and direction, this petition stands disposed of. 7.
