Mr.Dominic S.David, learned Government's counsel, takes notice on behalf of the respondents. 3. The learned counsel for the petitioners would submit that in these cases, initially, the petitioners had filed EP.Nos.41 of 2023, 62 of 2023 & 60 of 2023 before this Court seeking for execution of judgment and decree dated 17.07.2003, wherein a direction was issued for registration of sale deed dated
20.03.1991.
Subsequently, a draft sale deed dated 20.12.2024 was filed and the same was approved on 07.02.2025, following which, the petitioners paid a sum of Rs.68,000/- each as stamp duty. Under these circumstances, on 05.06.2026, this Court had forwarded the executed sale deed to the respondent for the purpose of registration. However, instead of registering the sale deed, the impugned notice came to be issued by the respondent on the ground that the stamp duty paid was insufficient and the same has to be calculated as per the present guideline value. Hence, these petitions. 5. In reply, the learned Government’s counsel, appearing for the respondent would submit that the aforesaid deed was not at all presented before the respondent. Further, he assured that if any such document/deed was presented, the respondents will proceed with the process of registration by following the due process of law. 6. Heard the learned counsel for the petitioner and the respondent and also perused the entire materials available on record. 7. In the cases on hand, the main grievance of the petitioner is with regard to the refusal of the respondent to register the petitioner’s sale deed on the ground that the stamp duty paid by the petitioner was insufficient. However, according to the respondent, the said deed was not at all presented before the respondent. 8. In view of the above, this Court directs the petitioners to present their respective sale deeds before the respondents. In such case, the respondents shall register the same, in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. If there is any disagreement, the matter shall be referred to the concerned District Collector under Section 47A of the Indian Stamp Act, 1899. 9. With the above directions, these writ petitions are disposed of. No costs.
