ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to pass orders on the appeal filed by the petitioner dated 01.07.2026.
2. The case of the petitioner is that his father acquired the subject property situated at Adambakkam Village by way of a registered Settlement Deed. The petitioner subsequently discovered that a third party had fraudulently obtained patta in respect of the property on the basis of fabricated documents. Upon the petitioner's complaint, the 2nd respondent cancelled the fraudulent patta, but, without proper justification and contrary to the recommendations of the Deputy Tahsildar and the Sub-Registrar, also cancelled the patta standing in the name of the petitioner's father. Aggrieved by the said order, the petitioner preferred a statutory appeal before the 1st respondent, which is still pending
consideration. Pending disposal of the appeal, the petitioner has filed the present writ petition seeking appropriate relief. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis

3. Mr. C. Prabakaran, learned Government Counsel appearing for the respondents, submitted that the appeal preferred by the petitioner dated 01.07.2026 would be considered and appropriate orders would be passed thereon, on merits within a period of eight (8) weeks, after issuing notice to the parties concerned.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court, without going into the merits of the matter, directs the 1st respondent to consider the petitioner’s appeal dated
01.07.2026. The 1st respondent shall pass appropriate orders on merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner as well as any other interested parties and affording them an opportunity of a personal hearing.
