ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner herein/Accused No.6, seeking regular bail, in Crime No.10 of 2016, of Donkarayi Police Station, East Godavari District, registered for the offences punishable under Section 8(c) read with 20 (b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act (for short “NDPS Act”).
2. The prosecution case, in brief, is that on 08.08.2016 at about 3.00 p.m., while the police conducting ride, caught hold A.3 and A.4 red-handedly and found they were in possession and transporting 120kgs of Ganja from Raju camp towards Telangana State.
3. Heard Sri Kadiyam Neelakanteswara Rao, learned counsel for the petitioner/accused No.6 and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Learned counsel for the petitioner would submit that basing on the confessional statements of A.3 and A.4, the petitioner/A.6 is implicated in this matter. He would further submit that the contraband seized from the possession of A.3 and A.4 and the case against A.3 and A.4 was ended in acquittal vide judgment, dated 06.12.2017 in NDPS SC No.15 of 2017 on the file of the Court of I Additional District and Sessions Judge, Rajamahendravaram, East Godavari District.
Learned counsel for the petitioner would further submit that after nine years of registration of the case, the petitioner is arrested on 12.01.2026 and since then he has been in judicial custody. Learned counsel would further submit that the petitioner herein is the son of A.3 and the petitioner is ready to furnish the sureties to the satisfaction of the court to secure his presence before the Court.

5. Learned Assistant Public Prosecutor, appearing for the State, vehemently opposed the petition and submits that this Court may pass appropriate orders.
6. Considering the above submissions and that the petitioner has been in judicial custody since 12.01.2026, this Court is inclined to enlarge the petitioner on bail with the following conditions: i. The petitioner/A.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the learned Special Sessions Judge for Trial of the cases under NDPS Act- cum-I Additional Sessions Judge, East Goadavari, Rajamahendravaram. ii. The petitioner/A.6 shall appear before the Investigating Officer as and when required and shall cooperate with further investigation, if any. iii. The petitioner/A.6 shall not directly or indirectly tamper with evidence nor influence, intimidate, or induce any prosecution witness. iv. The petitioner/A.6 shall appear before the Station House Officer, concerned, once in a week i.e., on every Sunday between 10.00 a.m. and 5.00 p.m. till filing of charge sheet. v. The petitioner/A.6 shall not commit or indulge in commission of any offence in future.
7. In the event of violation of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail.
8. It is also made clear that the observations made in this order are only for the purpose of deciding the bail application and they shall not be construed as opinion on the merits of the Crime.
9. Accordingly, this Criminal Petition is allowed.
