No. 950 of 2026 __________ Page2 of 4 For Petitioner(s): Mr. S.Sathish Rajan For Respondent(s): Mr.R.Ganesh Kumar Counsel for Government for R1 to R4 ORDER This Writ Petition has been filed to quash the order passed by the 3rd respondent dated 08.08.2025 and direct the respondents to remove petitioner name from the History Sheet List maintained by the 4th respondent. 2. It is seen that the petitioner was implicated as an accused in a criminal case. In view of his involvement, he was also detained under Act 17 of 1982, and a history sheet was opened against him in H.S. No. 16 of 2024 dated 02.10.2024. Thereafter, the petitioner submitted a representation seeking the removal of his name from the history sheet. However, the said representation was rejected, and the petitioner’s name was continued in the History Sheet. 3. The learned counsel for the petitioner submitted that the history sheet must be reviewed once a year as per P.S.O. 751. However, after 2024, the respondents retained the petitioner's name in the history sheet. It is further submitted that all the cases registered against him have ended in acquittal, and only one case is currently pending trial. https://www.mhc.tn.gov.in/judis WP Crl. No. 950 of 2026 __________ Page3 of 4 4. On a perusal of the records, it is seen that the history sheet was opened against the petitioner on 01.10.2024 by the 4th respondent solely based on the petitioner's breach of public peace. The petitioner has continuously acted in a manner prejudicial to public peace and tranquility. He has been involved in 11 previous cases, making him a habitual offender. Although 10 of these cases have already been disposed of, one case remains pending trial. Therefore, the representation submitted by the petitioner seeking the removal of his name from the history sheet was rightly rejected by the 3rd respondent. This Court finds no infirmity or illegality in the order passed by the 3rd respondent dated 08.08.2025. 5. Accordingly, this Writ Petition is dismissed. However, the 3rd respondent is directed to review the history sheet periodically, as contemplated under P.S.O. 751. 16-07-2026 SMA https://www.mhc.tn.gov.in/judis WP Crl.
