Adhyapak, learned counsel for the applicant/petitioner and learned Amicus Curiae, Mr. Darak Ullah, is present for the respondent no.2. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State. 2. Sri Pradip Kumar Dutta has filed this application stating that the dispute between both the parties have been amicably settled and an amount of Rs.2,60,000/- (Rupees Two Lakh Sixty Thousand) only has been paid as full and final settlement between both the parties 3. The case was brought up against the petitioner/applicant by the respondent no.2 with allegations of dishonor of cheque and CR(NI) Case No.04/2016 was registered and vide judgment and order dated 22.04.2021, the applicant was directed to pay a compensation of Rs.7,20,000/- (Rupees Seven Lakh Twenty Thousand only) to the respondent no.2 i.e. the complainant Shri Rupamjyoti Baruah. 4. Annexure-5 of the application is the deed of compromise agreement executed between the wife of the applicant, namely, Smt. Shewali Dutta and the respondent no.2, namely, Shri Rupamjyoti Baruah. 5. I have considered the submissions at the Bar. 6. It is submitted that indeed a settlement was arrived at and the complainant has received an amount of Rs.2,60,000/- (Rupees Two Lakh Sixty Thousand) only and a deed of compromise was executed between the respondent no.2 as well as the wife of the petitioner/applicant. Page No.# 4/4 7. The money receipt is annexed along with the Annexure-5, which has been signed by the respondent no.2. 8. As the applicant was aggrieved by the judgment and order dated 12.12.2025, passed by the learned Sessions Judge, Golaghat in Criminal Appeal No.21/2021 upholding the judgment and order dated 22.04.2021, passed by the learned SDJM(M), Bokakhat in CR(NI) Case No.04/2016, he preferred the Criminal Revision Petition No.125/2026 against the impugned judgments and orders. 9. As both the parties have amicably settled their dispute, this Criminal Revision Petition No. 125/2026 is allowed on compromise and the impugned order dated 12.12.2025, passed by the learned Sessions Judge, Golaghat in Criminal Appeal No.21/2021 is set aside. The impugned order dated 22.04.2021, passed by the learned SDJM(M), Bokakhat in CR(NI) Case No.04/2016 is also set aside. 10. Petitioner/applicant who is behind bars in connection with the original case i.e. CR(NI) Case No.04/2016 is to be released. 11. Accordingly, this interlocutory application stands disposed of.
