This is first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.51/2024 registered at Police Station – Khadgaon, District- Mohla-Manpur-Ambagarh Chowki (C.G.) for the offences punishable under Sections 379 of the Indian Penal Code. Prosecution case in brief is that the complainant Mukesh Kumar Nirmalkarhad made written report in Police Station Khadgaon, District – Mohla Manpur Ambagarh on 10.06.2024, alleging therein that unknown person had stolen Motorcycle No.CG24M/9116 and Mixer Machine parked in from of the house of the Contractor Anklesh Sahu. On the said complaint FIR has been registered against the unknown person. 3. Learned counsel for the applicant submits that the applicants are innocent and they have falsely been implicated in the present case. He would submit that the material collected by the prosecution, there is no offence is made out against the present applicants, and there are nothing on record to show that the present applicants have committed the alleged offence. Further more investigation and trial are likely to take time, therefore, he submits that the present applicants are entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that there are five-five criminal antecedents registered against the both applicants, it appears that applicants are habitual offender, therefore, they are not entitled to be granted anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties, allegation levelled against the applicants and also considering the fact that both applicants have five criminal antecedents each, it appears that 3 applicants are habitual offender. as such, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the anticipatory bail application of the applicants– Niranjan Singh Banjare and Takesh Kumar Bharti filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.51/2024 registered at Police Station – Khadgaon, District- Mohla-Manpur-Ambagarh Chowki (C.G.) for the offences punishable under Sections 379 of the Indian Penal Code, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
