ORDER This Civil Revision Petition has been filed challenging the impugned
order dated 06.06.2026 passed by the Sub Court, Kangeyam in I.A.No.8 of 2026 in O.S.No.327 of 2019 .
2. In the aforesaid order, the application filed by the petitioner who is the defendant in the suit, seeking to recall P.W.1 to P.W.4, under Order XVIII Rule 17 of Civil Procedure Code has been dismissed.
3. As seen from the impugned order, the application has been dismissed on the ground that the petitioner has filed the said application only to procrastinate the proceedings and the petitioner is habitually filing several applications without any justifiable reasons.
4. As seen from the impugned order, the Trial Court has also recorded the several opportunities granted to the petitioner/defendant in the suit to protect his interest. In fact the Trial Court had passed an exparte Judgement in favour of the respondent/plaintiff against the petitioner/defendant which was subsequently set aside on an application filed by the petitioner/defendant. It is noticed by this Court that even for completion of the trial, the petitioner/defendant had taken several adjournments. CRP No. 4350 of 2026 __________ Page3 of 4 has filed once again an application in I.A.No.8 of 2026 seeking to recall P.W.1 to P.W.4. The suit is for recovery of money based on a promissory note. The Trial Court has given sound reasons for dismissing the petitioner’s application.
