In this writ application, the petitioner has prayed for unfreezing the Bank Account of the petitioner held in different Banks which were seized during raid in connection with an FIR lodged against the son of the petitioner namely Siddartha Jaiswal bearing FIR No. RC0932019E0007 dated 24.12.2019 of CBI, EOB, Ranchi. The petitioner has also prayed for release of the Bank Locker Key of the petitioner maintained in Punjab National Bank, Varanasi on account of the fact that final form has been submitted in favour of the son of the petitioner. 3. A First Information Report was registered by the CBI relating to coal scam against M/s Corporate Ispat Alloys Ltd. and several other individuals who were part of the Company including the son of the petitioner namely Siddartha Jaiswal who was one of the Directors of the Company. In course of investigation, the house of Siddartha Jaiswal was raided and the Bank Account of the petitioner and the Bank Locker Key were also seized. On completion of investigation, charge-sheet was submitted against several accused persons but the same excluded Siddartha Jaiswal as no incriminating evidence was found against him. Based on such background facts, this writ application has been preferred for unfreezing the Bank Account of the petitioner held in different Banks as well as to release the Bank Locker Key of the petitioner maintained in Punjab National Bank. 4. Learned counsel for the petitioner has submitted that in the counter- affidavit filed by the CBI a specific statement has been given that the CBI does not have any objection to unfreeze the Bank Account of the petitioner as well as to release of the locker since no incriminating evidence had come on record against Siddartha Jaiswal during the course of investigation. 5. Learned ASGI has reiterated the averments made in the counter- affidavit with respect to his no objection to the prayer made in this writ application. 6. On consideration of the prayer made in the writ application as well as the admission on the part of the CBI that no incriminating material was found against Siddartha Jaiswal, the son of the petitioner, there does not appear to be any other impediment in unfreezing the Bank Account of the petitioner as well as releasing the keys to the locker of the petitioner maintained in Punjab National Bank. 7. Regard being had to the aforesaid facts, therefore, the concerned respondents are directed to unfreeze the Bank Accounts of the petitioner and release the Bank Locker Key, the details of which has been provided in paragraph no.9 of the instant writ application, within a period of two weeks from the date of receipt/ production of a copy of this order. 8.
