Kausik (Allowed) CRM (NDPS) 100 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bagdah Police Station Case No. 290/2016 dated 13.04.2016 under Sections 379/411/414 of IPC and Section 27/27A of Drugs and Cosmetics Act. And In the matter of : Abhijit Halder ……Petitioner. Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha ……for the Petitioner. Mr. Avishek Sinha Mr. Aritra Bhattacharya ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 11 months for alleged recovery of 66 bottles of Phensedyl. Learned advocate for the State submits that twice petitioner was granted the liberty of bail, but he has jumped bail and on the last occasion he has been detained for a considerable period of time. The case which is the subject matter is of 2016. Having regard to the period of detention of the petitioner, learned Trial Court is directed to release the petitioner on bail on furnishing the title deed of the property of the petitioner or any of his relation within the jurisdiction of Bagdah Police Station. 2 Learned Special Court would cross-check regarding the authenticity of the title deed and thereafter release the petitioner on bail. Petitioner, if he is on bail, he shall meet with the Inspector-in-Charge of Bagdah Police Station or any officer deputed by him once in a week till the same is modified by the learned Trial Court. With the aforesaid observations CRM (NDPS) 100 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
