The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the property in respect of the survey numbers covered in the patta Nos.1466,1467, 1468, 1469, 1470 and 1471, dated 02.07.2013 by virtue of registered sale deeds. The petitioner has been in possession ever since the purchase of the land. While so, one Subramani, S/o.Munusamy had executed a forged settlement deed in favour of his wife S.Saroja vide Doc. No.10145 of 2007, dated 25.04.2007 and based on the same, he got mutation of records in his wife's name. Therefore, the petitioner made a representation on 12.08.2011 before the first respondent to cancel the patta issued in favour of the https://www.mhc.tn.gov.in/judis WP No. 24650 of 2026 __________ Page3 of 6 said Saroja. The first respondent vide his proceedings dated 24.07.2012 directed the second respondent to issue patta based on the judgment in O.S.Nos.204 and 205 of 2009 and O.S.No.226 of 2013 filed by the petitioner challenging the forged settlement deed. In the meanwhile the third respondent has obtained a fraudulent power of attorney from the legal heirs of S.Saroja vide document No.969 of 2010 dated 14.10.2010 and 5886 of 2018, dated 07.06.2018 and disturbing the possession of the petitioner. Therefore, the petitioner lodged a criminal complaint against the third respondent which was registered as FIR No.74 of 2024 and is under investigation before the Avadi Central Crime Bureau. The petitioner has now applied for computer patta for the Patta Nos.1166 and 1167 dated 24.07.2012. Under these circumstances, the petitioner has filed this Writ Petition. 3. The learned Government Advocate appearing for the respondents 1 and 2 submitted that based on the proceedings issued by the first respondent dated 24.07.2012, the second respondent by proceedings dated 14.12.2012 cancelled the patta Nos.1466,1467, 1468, 1469, 1470 and 1471 issued in favour of S.Saroja and hence, the first part of the prayer of the petitioner has become infructuous. 4. Considering the submission of the learned counsel on either side, this Court is of the view that though the part of the prayer has become infructuous by virtuous of the order of cancellation of patta issued by the second respondent dated 14.12.2012 in respect of patta Nos.1466,1467, 1468, 1469, 1470 and 1471 based on the proceedings of the first respondent dated 24.07.2012 and now the petitioner had applied for computer patta for the physical Patta Nos.1166 and 1167, dated 24.07.2012 for which chitta also issued on 19.11.2012, there is no impediment for the second respondent to issue computer patta in the name of the petitioner. Therefore, this Court directs the second respondent to issue computer patta for the Patta Nos.1166 and 1167 for the subject properties in the name of the petitioner within a period of five days from the date of receipt of a copy of this order. 6. With the above direction, this Writ Petition is disposed of. No costs.
