01. Petitioner, through the medium of this petition, asserting that he was allotted the works of Water Supply Scheme (WSS), Arai in response to e-NIT No. 44 of 2022-23 dated 07.06.2022, and Water Supply Scheme (WSS) Noorkote vide e-NIT No. 04 of 2022-23 dated 17.04.2022, pursuant to which he had executed 75% of work of Noorkote and 60% of Work of Arai and the petitioner was entitled to be released of his claims on a monthly basis, as per the agreement executed between the petitioner and the respondents. It has been argued that the respondents have not paid the petitioner, whole of the amount due as per the agreement. Serial No. 178

Learned counsel for petitioner submits that the petitioner shall be satisfied, if this petition is disposed at this stage, with a direction to the respondents to consider his plea raised in this petition with regard to release of payment in respect of his admitted claims upon completion of work.

Learned counsel for the respondents submits that respondents are not averse to the plea raised by the petitioner, for consideration.
07. The claim of the petitioner, with regard to completion of 75% work of Noorkote, WSS and 60% of Arai WSS, has been certified by Executive Engineer of Jurisdictional Jal Shakti, Division.
08. Having regard to the pleadings and the submissions made by the
learned counsel for the petitioner, the present petition is disposed of, at this motion stage, with a direction to the respondents to consider the plea of the petitioner with regard to release of his payment, in terms of the allotment/agreement.
09. Petition, is thus, disposed of, along with connected application(s).
