And In the matter of : Sanjoy Jana ……Petitioner. Mr. Prasun Kr. Dutta, Ld. APP Mr. Santanu Deb Roy, ……for the State. The present application for cancellation of bail has been filed in respect of the order dated 29.09.2022. None appears for the petitioner. State has submitted a report which reflects that charge-sheet was submitted under Section 498A/304B/306/34 of the Indian Penal Code against the accused persons. The case was committed to the Court of Sessions and next date has been fixed on 09.03.2026 for appearance of accused and consideration of charges. Having considered that the case was registered in the year 2022 and charge-sheet has been submitted in the year 2023, I direct the learned trial Court to expedite the process of consideration of charges. If there are non-cooperation from the accused persons, the learned trial Court would if circumstance so warrant issue harsher process of law, thereafter if required, cancel the bail. 2 However, at this stage, since there is lack of persuasion on behalf of the petitioner and custodial detention is unwarranted as investigation has been completed. The only issue which is left is obstruction created in the progress of the trial which can be best adjudicated by the learned trial Court. Accordingly, CRM (DB) 1452 of 2023 is dismissed with the aforesaid observation. Learned trial Court, if required, act accordingly for expediting the trial. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
