ORDER The prayer is in this criminal original petition is to quash the charge sheet filed in CC No.931 of 2025. 2.Upon considering the arguments of the learned counsel on either side and perusing the first information report, the material collected during the investigation and the final report, the crux of the allegations in this case is that one Prema is the original owner of the property having been purchased the same by a sale deed dated 04.03.1998. A2 impersonating as Prema executed two general power of attorney in respect of both the plots in favour of Nagendra Singh/A1. The accused No.1 Nagendra Singh by two sale deeds in turn conveyed the property to one Surya Prakash the accused No.5, who is the brother of the petitioner/accused No.3 and to one R.N. Kumar/accused No.4, who is the friend of the petitioner/accused No.3, in both the sale deeds the petitioner also stood as a witness. 3.The learned counsel for the petitioner would submit that except for signing as a witness, the petitioner had not participated in the crime and absolutely, he is not the beneficiary and the property is also now given back to the said Prema. https://www.mhc.tn.gov.in/judis
CRL OP No. 19575 of 2026 __________ Page3 of 5 4.I have considered the said allegations. 5.Prima facie, to proceed against the petitioner, there is material inasmuch as the petitioner stood as witness in two sale deeds, both executed by A1, one in favour of the very own brother of the petitioner, another one in favour of the friend of the petitioner. Whether the petitioner stood as a witness unknowingly and whether he is not part of the conspiracy will all come to light only during the course of the trial. This argument of the petitioner cannot be treated as incontrovertible so as to entertain the quash application. 6.Therefore, keeping open the liberty of the petitioner to raise all the grounds during the course of the trial, the criminal original petition stands
disposed of. At this stage, the learned counsel for the petitioner pleads hardship for the petitioner to appear before the trial Court. In view of the said submission, the presence of the petitioner before the trial Court shall stand dispensed with except for such hearings as may be insisted upon by the trial Court. Consequently, connected miscellaneous petitions are closed. 23-07-2026 Neutral Citation: Yes/No sms https://www.mhc.tn.gov.in/judis
