Pachaiyappan Government Counsel for R1 to R3 Mr.Durai Gunasekaran Government Counsel (Crl.Side) for R4 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 3 and 4 to consider the petitioner’s representation dated 17.06.2026. 2. The case of the petitioner is that he submitted a representation dated 17.06.2026, requesting respondents 3 and 4 to survey the petitioner’s properties comprised in Survey No. 422/2C measuring an extent of 49.4 cents, and Survey __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 28235 of 2026 No. 422/3 measuring an extent of 1.45 acres, situated at Jittopanapalli Village, Krishnagiri District, and to provide adequate police protection during the survey proceedings. However, the same has not been considered till date. Aggrieved by the inaction on the part of respondents 3 and 4, the petitioner has been constrained to file the present Writ Petition. 3. In reply, Mr. B.Pachaiyappan, learned Government Counsel appearing for the respondents submitted that the representation of the petitioner dated 17.06.2026 will be considered by the 3rd respondent, who is the competent authority and appropriate orders would be passed thereon on merits and in accordance with law, within a period of ten (10) weeks. 4. In view of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs the 3rd respondent to consider the petitioner's representation dated 17.06.2026 on merits and in accordance with law. The 3rd respondent shall conduct a survey of the subject property comprised in Survey No 422/2C to an extent of 49.4 cents and survey No 422/3 to an extent of 1.45 acres situated at Jittopanapalli village, Jagadevapalliya, Krishnagiri District and fix the boundary stones within a period of ten (10) weeks from the date of receipt of a copy of this order, after __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 28235 of 2026 issuing prior notice to the petitioner, adjacent land owners and interested parties, if any. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 4th respondent/ jurisdictional Police, and the 4th respondent Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
