The learned counsel appearing for the petitioners submitted that the properties purchased by the petitioners form part of a residential layout known as "Agri Gold Eco Prince Valley," situated at Choodagondappalli Village, Hosur Taluk, Krishnagiri District, comprised in various survey numbers measuring a total extent of 38 acres and 70 cents. He submitted that the layout was approved as house plots and the petitioners are in peaceful possession and enjoyment of their respective properties. Agri Gold subsequently came to be implicated in proceedings under the depositors' protection enactments, pursuant to which steps were taken to identify and attach properties belonging to the said company. 3. The petitioners had no notice or knowledge of any alleged criminal proceedings against the vendor company at the time of purchase. The properties purchased by the petitioners were acquired prior to the year 2015, much before the initiation of subsequent criminal proceedings relating to the Agri Gold Group of Companies. Hence, the petitioners' independently acquired properties https://www.mhc.tn.gov.in/judis WP No. 18303 of 2026 __________ Page9 of 11 cannot be treated as assets of Agri Gold or subjected to attachment proceedings. Recently, the 3rd respondent Sub-Registrar placed a restriction on the registration of properties situated in these survey fields by treating them as properties connected with the Agri Gold proceedings. As a result, the registration of the petitioners’ properties is not being permitted. Furthermore, the respondents cannot mechanically include the properties of innocent third- party purchasers in attachment proceedings without verifying the title. Aggrieved by the same, and having no other alternative remedy, the petitioners have approached this Court by filing these writ petitions. 4. The learned Government Counsel appearing for the respondents submitted that no documents have been presented before the 3rd respondent thus far. He contended that in the event any document is presented for registration, the same will be considered and registered after a due enquiry as to whether the subject properties are subject to any attachment proceedings. 5. In such view of the matter, the petitioners are directed to present their documents before the concerned respondent Sub-Registrar. Upon such presentation, the respondent is directed to receive the same, conduct an enquiry, and pass appropriate orders on merits in accordance with law, taking into consideration whether any attachment has been made by the enforcement authorities. https://www.mhc.tn.gov.in/judis WP No. 18303 of 2026 __________ Page10 of 11 6. Accordingly, these Writ Petitions stand disposed of with the above directions. No costs. Consequently, connected W.M.P.
