The petitioner is apprehending his arrest in connection with Chandankiyari P.S. Case No. 157 of 2025, registered for the offence under Sections 303(2), 317(5), 3(5) of Bhartiya Nyaya Sanhita, 2023, Section 21 of Mines and Mineral (Development and Regulation) Act, 1957, Section 54 of Jharkhand Minor Mineral Concession Rules, 2024 and Rule 13 of Jharkhand Mineral (Prevention of Mining, Transpiration and Storage) Rule, 2017 pending in the court of learned Judicial Magistrate, 1st Class, Bokaro. 3. Learned counsel appearing for the petitioner submits that the petitioner happens to the driver of the Hyva truck and the allegations are made that 1000 CFT stone chips was loaded in the said Hyva truck. It is submitted that the petitioner is working in the Maa Kali Construction and the said truck is registered in the name of Maa Kali Construction and the proprietor of the said Company has been granted anticipatory bail in A.B.A. No.5633 of 2025. He also submits that the petitioner is not having criminal antecedent which is stated in para 13 of the bail application. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the stone chips was loaded in the Hyva truck. 5. Considering that the petitioner is the driver and he was working in Maa Kali Construction, in whose name the Hyva truck was registered and the proprietor of Maa Kali Construction has been granted anticipatory bail in A.B.A. No.5633 of 2025, and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
