PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to grant pre-arrest bail to the Petitioner/Alleged to be accused in Crime No.20 of 2026 of Penamaluru Urban Police Station, Krishna District, registered for the alleged offence punishable under Section 194 of the ‘BNSS’. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor, submits that the Petitioner has not yet been arraigned as an accused in the said crime. 4. Mr.V.R.Maheswara Rao Paleti, the learned counsel for the Petitioner, submits that the Petitioner was served with a notice under Section 179 of ‘the BNSS’ by the Inspector of Police, Gudivada CCS‑II, Krishna District. In the said notice, the Petitioner was required to attend before the Inspector for investigation. It was further mentioned that non‑compliance with the notice would amount to an offence under Section 208 of ‘the BNS’ 5. On perusal of the record, no case has yet been registered against the Petitioner, nor has he been formally arraigned as an accused. Hence, the apprehension of arrest entertained by the Petitioner is premature. 3 6. In view of the above, the Criminal Petition is dismissed. However, liberty is granted to the Petitioner to file an appropriate application in accordance with law.
