For Respondents : M/s.R.Hemalatha (in W.A.No.2203/26) JUDGMENT (Judgment of the Court was delivered by the Hon'ble Chief Justice) These writ appeals, which are filed under Clause 15 of the Letters Patent, assail the order dated 18.06.2025 passed in W.P.No.21608 of 2025 and the order dated 20.03.2025 passed in W.P.No.11789 of 2024 respectively, which have been disposed of directing to issue NOC to respondents herein. __________ https://www.mhc.tn.gov.in/judis W.A.Nos.2202 & 2203 of 2026 2. Respondents had filed writ petitions seeking the following reliefs: "W.P.No.21608 of 2025 seeking a writ of Mandamus directing the respondents to issue NOC in respect of the land situated in S.F. Nos.479/3 480/3, 479/4 and 480/4 at Kasipalayam C- Village, (Erode E village), Erode District so enable the petitioners to register the same before the Sub Registrar office. W.P.No.11789 of 2024 seeking a writ of Mandamus directing the respondents to issue NOC in respect of the land situated in S.F.Nos.479/3, 480/3, 479/4, and 480/4 at Kasipalayam C-Village, (Erode E Village) Erode District so enable the petitioners to register the same before the Sub Registrar Office." 3. The learned Single Judge, relying on the order dated 12.03.2025 passed in W.P.No.8453 of 2025, where similar claim was allowed, had disposed of the writ petitions. 4. Learned Additional Advocate General submitted that now the Housing Board has developed the housing colony and large __________ https://www.mhc.tn.gov.in/judis W.A.Nos.2202 & 2203 of 2026 number of plots have been sold where houses have already been constructed, thereby creating third party rights and therefore, the direction issued by the learned Single Judge to issue NOC to respondents cannot be sustained. 5. We have heard learned counsel for the parties and perused the records. 6. On perusal of the records, it is revealed that the G.O., by which entire lands were acquired, was quashed in the year 2001 itself. Subsequently, the review petition was also dismissed for want of prosecution in the year 2002. When the acquisition proceedings itself stand quashed, the view taken by the learned Single Judges cannot be faulted with. The learned Single Judges have relied on an identical matter and disposed of the writ petitions and thus, the learned Single Judges have not committed any error in disposing of the writ petitions. __________ https://www.mhc.tn.gov.in/judis W.A.Nos.2202 & 2203 of 2026 7. The writ appeals being bereft of merits and substance are hereby dismissed. There shall be no order as to costs. Consequently, the interim applications are also dismissed.
