2. Mr. Rajeev Singh Bisht, Deputy Advocate General for the State of Uttarakhand.
3. Petitioner is serving as Assistant Teacher, L.T. Grade in a Government Higher Secondary School in District Almora. According to him, he is entitled to benefit of Government Order dated 22.02.2010, however, said benefit has not been given to him so far.
4. The relief sought in the writ petition is as follows: -
“(i) A writ order or direction in the nature of mandamus commanding the respondents to grant/ sanctioned the promotional pay scale pursuant to the government
order dated 22.02.2010 with the arrear from the date the claim of the petitioner is due when the petitioner has completed 22 years of the services. (Contained as Annexure No. 4 page no. 40 to 56 To this writ petition).
5. Learned State Counsel submits that petitioner has sought a writ of mandamus without making any representation, therefore, the writ petition would not be maintainable.

Learned counsel for the petitioner, however, disputes the said contention and submits that petitioner has made a representation, however, the same could not be enclosed with the writ petition.

7. Having regard to the relief sought in the writ petition, this Court thinks that ends of justice would be met, if petitioner is permitted to make fresh representation.
8. Accordingly, the writ petition is
disposed of by permitting the petitioner to make representation to the competent authority. If petitioner makes representation within two weeks from today, decision thereupon shall be taken as per law, within three months thereafter.
