The present review application has been instituted to review the order of this Court dated 30.06.2026 passed in W.A.No.1591 of 2024. 2. The present review petition has been filed by the learned counsel, who had not appeared for the appellant in the writ appeal. This Court, considered the provisions of the Tamil Nadu Pension Rules, 1978 and disposed of the appeal. 3. The learned review petitioner would submit that the deceased government servant, at the time of his death, left beyond three Class-I legal heirs including the review petitioner. Therefore, the service benefits of the deceased government employee should be divided equally amongst the three surviving legal heirs. This aspect was considered by this Court and in the context of the Pension Rules and as far as Death cum Retirement Gratuity (DCRG) is concerned, the Government employee is entitled to nominate any person to receive the same. In the present case, the deceased government employee nominated his mother who would fall under the definition, “family”. Since valid nomination has been made by the deceased employee, the authorities are bound to settle the DCRG in favour of the nominee. If at all family dispute exists, it is to be resolved in the manner known to law.
