The petitioner is an accused in connection with Borio (J) P.S. Case No. 368 of 2019. It has been alleged that the accused persons on 09.08.2019 had looted two hyva drivers near Bhawanichak. Learned counsel for the petitioner has submitted that one of the co-accused Md. Sarfaraj has been granted bail in B.A. No. 8027 of 2025. It has been submitted that the petitioner is custody since 20.08.2025. It has further been submitted that there has been no recovery effected from the conscious possession of the petitioner. Learned Spl.PP has opposed the prayer for bail of the petitioner and has submitted that the petitioner is named in the First Information Report and he has several criminal antecedents which have not been specifically stated in this application. The petitioner appears to have been named in the Frist Information Report and so is Md. Sarfaraj who has been granted bail in B.A. No. 8027 of 2025. There does not seem to be any distinguishing feature between the case of the present petitioner and that of Md. Sarfaraj and considering the same, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Borio (J) P.S.
