This first bail application has been moved by the applicant seeking regular bail in F.I.R./Case Crime No.417 of 2025, under Section 191(2), 191(3), 121(1), 132, 221, 352, 351(2), 324(3), 190, 196(C), 109 of B.N.S., 2023 and Section 7 of Criminal Law Amendment Act and Section 3 of Prevention of Damage to Property Act, registered at P.S. Kashipur, District Udham Singh Nagar. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime and is languishing in jail since 23.09.2025. It is contended by learned counsel for the applicant that co-accused, namely, Aaris has already been enlarged on bail by Coordinate Bench of this Court in BA1 No.2021 of 2025 vide order dated 10.01.2026. He submits that this is a case of parity and in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel has vehemently opposed the prayer for bail. 5. Considering the submission of 2026:UHC:627 learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage on the ground of parity. 6. The bail application is allowed. 7. Let the applicant, namely, Moeen Raza be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
