That, the Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioner. II. The Hon'ble Court may kindly be pleased to quash the F.I.R. Crime no. 159/2023 registered as police station D.D. Nagar Raipur u/s 420, 34 of I.P.C. III. That, the Hon'ble Court may kindly pleased to quash the entire charge sheet filed on dated 05.09.2023 for the offence committed under Section 420, 34 of IPC in Criminal Case No. 696/2024 pending before Judicial Magistrate First Class Raipur, District Raipur (C.G.). IV. That, the Hon'ble Court may kindly be pleased to quash/set aside the cognizance order dated 29.01.2024 under Section 420, 34 of IPC and the proceedings in Criminal Case No. 696/2024 pending before the court of Judicial Magistrate First Class Raipur District Raipur (C.G.), in the interest of justice.” 3. On a pointed query being made from the learned counsel for the petitioner that, whether any charges have been framed against the petitioner or not, he would submit that, no charges have been framed against him till date. Learned counsel for the petitioners would submit that, he may be permitted to withdraw the present petition with liberty to file afresh, supported by relevant order sheets of trial Court. 3 4. Considering the fact that, the order sheet of the trial Court has not been annexed, the present petition is dismissed as withdrawn with the liberty to file a duly constituted petition along with the relevant order sheets of the trial Court.
