(Oral) On 09.10.2025, this matter has been referred to mediation. With the sincere efforts made by learned Mediator, matter has been settled between the parties.
2. Not only the matter has been settled, but in pursuance of the said settlement, exchange of land has 1 Whether Reporters of local papers may be allowed to see the judgment? Yes.
2 2026:HHC:4954 already been taken place and said fact has also been duly reflected in the revenue record.
3. In view of the settlement between the parties, which has already been given effect to, on the spot and reflected in the revenue record, the learned counsel appearing for the petitioners, under instructions, has submitted that petitioners do not want to proceed further with the present case and wants to withdraw the same.
4. Whatsoever stated by learned counsel appearing for the petitioners, has not been disputed by
learned counsel appearing for respondents No. 1(a) to 1(c).
5. In view of the joint submissions made by
learned counsel for the parties, the present petition is dismissed as withdrawn, being settled before the learned Mediator. The parties shall be bound by their statements made before the learned Mediator. As per the undertaking, respondents No. 1(a) to 1(c) will withdraw the Execution Petition, pending before the Executing Court, after placing on record the copy of order of this Court. Similarly, the petitioners, who have filed the civil suit, will also withdraw the same, in view of the compromise, which has been effected between the parties before the learned Mediator.

6. Pending miscellaneous application(s), if any, shall also stand disposed of.
