ORDER The present Application has been filed to direct payment out of a sum of Rs.55,00,000/- (Rupees Fifty Five Lakhs only) deposited by the Judgment Debtors to the credit of E.P.No.126 of 2025 in C.S.(Comm.Div).No.941 of 2010, together with accrued interest, if any to the Applicant/Decree Holder.
2. When the matter was taken up for hearing on 03.07.2026, taking note of the earlier deposit of Rs.50,00,000/- pending SLP which came to be dismissed thereafter and also payment of further sum of Rs.5,00,000/-, this Court had directed the Judgment Debtor to file an affidavit of undertaking indicating the schedule of payment of balance amount. An application had been taken out by the Decree Holder for payment out of the amount deposited by the
Judgment Debtor particularly in view that the judgment and decree upon which the Execution Petition had been filed had attained its finality in view of the rejection of the SLP even at the stage of condoning delay. The Judgement Debtor even though had indicated that they had sought to file a Review before the Hon’ble Apex Court as of today, there is no Review which had been placed on record and the judgment and decree had attainted its finality. https://www.mhc.tn.gov.in/judis

In this context, this Court finds no impediment in ordering the application as prayed for and accordingly, the present application stands ordered with a directed to the Registry to pay a sum of Rs.55,00,000/- which has been kept in deposit to the credit of the Execution Petition together with interest on a Memo being filed by the applicant/ Decree Holder without reference to the respondent/ Judgement Debtor.
