2. The grievance of the petitioner is that she is part of the surcharge proceedings.
However, when the surcharge proceedings were questioned before the Special Tribunal for Cooperative Cases, Chennai, proceedings were set aside mainly on the ground that loan amounts were already paid and the petitioners cannot be attributed with any kind of misappropriation. 3. The learned counsel appearing for the respondents would submit that against the above said orders, in C.M.A., preferred by the petitioner before the District Court and C.R.P is being preferred by the respondents before this Court. 4. Be that as it may. Since the petitioner is a widow, this Court is of the considered view that the request of the petitioner for settling the retiral benefits and other benefits, may be considered by the respondents, if the same is in accordance with law. 5. Accordingly, this Court direct the respondents to consider the request of the petitioner and release all service, financial benefits, retirement benefits and other benefits including the retained amount to the petitioner, if the same is in accordance with law. https://www.mhc.tn.gov.in/judis
