1. Mr. S.K. Shandilya, learned counsel for the applicant.
2. Ms. Sweta Dobhal, learned Brief Holder for the State.
3. Present applicant Paras, S/o Rajkumar is praying for anticipatory bail in reference to FIR dated 20.10.2025, bearing FIR No. 1023 of 2025 registered at P.S. Laksar District Haridwar wherein the present applicant has been implicated for the offence punishable under section 109, 3(5) of BNS 2023.
4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and there is an apprehension of arrest. He further submits that the applicant always cooperate with the investigation, however, I.O. submitted the charge sheet for the offence punishable under Section 109 read with 3(5) of BNS 2023. He also submits that on the charge sheet the concerned Magistrate took cognizance and summoned the present applicant. He submits that even in the charge sheet no specific role has been assigned to the present applicant. The statement of the informant and injured during investigation were also placed on record.

Learned counsel for the applicant further submits that the present applicant is not previously convict and there are three other cases ; first case relates to Case Crime No. 658 of 2024 wherein the present applicant is facing trial for the offence punishable under Section 109, 323(4) of BNS 2023, P.S. Kotwali Roorkee, District Haridwar. In another case applicant is facing trial is for the offence punishable under Section 109 of BNS 2023 read with Section 3, 25 of Arms Act, arising out of Case Crime No.
2026:UHC:3608 0494 of 2024, P.S. Bahadrabad, District Haridwar and the third case relates to Case Crime No. 0361 of 2023 wherein the present applicant is facing trial for the offences punishable under Sections 147, 148,149, 307 and 504 IPC at P.S. Laksar District Haridwar. He submits that the applicant disclosed about his criminal history but so far as present case is concerned, he is innocent and the I.O. submitted the charge sheet in a very cursory manner.

Mr. Sweta Dobhal, learned Brief Holder for the State seriously opposed the anticipatory bail application and submits that I.O. concerned after thorough investigation collect all material evidence and then filed charge sheet. She also submits that the present applicant indulge in criminal activities since long back and as on date he is facing trial in three case which itself reveals that the present applicant is habitual offender.
7. After hearing the arguments of the
learned counsel for the parties and taking into
consideration that after collecting all material evidence charge sheet has been filed and further the applicant has a criminal antecedent and facing trial, therefore, this Court does not find any merit in the instant anticipatory bail application. Accordingly, same is rejected being devoid of merit.
8. No order as to costs.
