This Writ Petition has been filed seeking to quash the proceedings dated 24.06.2026 issued under Section 7 of the Tamilnadu Land Encroachment Act, 1905 (in short “the Act”), by the fourth respondent. 2 / 5 https://www.mhc.tn.gov.in/judis W.P.No.28429 of 2026 2 Learned counsel for the writ petitioner would submit that subsequent to the impugned proceedings dated 24.06.2026, the authority has passed the order under Section 6 of the Act and hence he filed a miscellaneous petition to amend the prayer challenging the order passed under Section 6 of the Act, which is yet to be numbered. 3 The writ petitioner challenged the impugned proceedings issued by the fourth respondent under Section 7 of the Act and according to the learned counsel for the writ petitioner, subsequent to the show cause notice issued under Section 7 of the Act, the authority has passed order under Section 6 of the Act and he filed miscellaneous petition to amend the prayer to the effect of challenging the order under Section 6 of the Act. Assuming that the said miscellaneous petition seeking amendment of prayer is numbered, no purpose would be served, since as against the order passed under Section 6 of the Act, there is efficacious appeal remedy available for the petitioner before the District Collector under Section 10 of the Act. 4 Hence this Court is not inclined to grant any relief as sought for by the petitioner and accordingly the Writ Petition shall stand dismissed.
