The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.2 and 4 on bail in Crime No.210 of 2025 of Kirlampudi Police Station, Kakinada District, registered against the Petitioners/Accused Nos.2 and 4 herein for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Mr.V.Bala Krishna, the learned counsel for the Petitioners, submits that the Petitioners are innocent of the alleged offence and they have been falsely implicated in the alleged offence. They have not committed any offence. They are law-abiding citizens. They have got fixed abode. The Petitioners undertake to abide by any conditions that this Court may impose while granting bail to the Petitioners. Therefore, he prays that the present petition be allowed. 3. Per contra, Mr.A.Rohit, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioners and submitted that though the charge sheet has already been filed in the case, the accusations against the petitioners are well founded. 4. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, this is the second bail application filed by the petitioners/Accused Nos.2 and 4. On the earlier occasion, a learned Single Judge of this Court, by order dated 10.02.2026, dismissed the first bail application filed by the petitioners.
The petitioners were arrested on the spot while they were allegedly dealing with 24.690 kgs of ganja, which is a commercial quantity. After a thorough investigation, the charge sheet was filed within the statutory period of 180 days, and the case has been numbered as NDPS S.C. No.79 of 2026. One similar adverse antecedent under the provisions of ‘the NDPS Act’ has been reported against the petitioners. A perusal of the averments made in the charge sheet prima facie discloses that the accusations against the petitioners are well founded. 6. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioners/Accused Nos.2 and 4, and in view of the fact that there is no change in the circumstances from the date of dismissal of the first bail application till the filing of the present (second) bail application, this Court is not inclined to enlarge the petitioners/Accused Nos.2 and 4 on bail at this juncture. Hence, this Court finds no merit in the Criminal Petition. Accordingly, the Criminal Petition is liable to be dismissed. 4 Dr.YLR,J Crl.P.No.5232 of 2026 Dated 14.07.2026
