3. Pandurangan S/o Late S.P.Muthusamy Chettiar No.80/104, Krishna Colony Circle, Eri Extension, Sankar Nagar, Salem 636 007 ..Respondent(s) PRAYER : To accept the cause title filed in the present CRP Sr.No.112449 of 2026 to challenge the Commissioner report dated 13.11.2025 followed by the Warrant and Ameena report dated 17.03.2026 and 30.03.2026 respectively made in REP.No.307 of 2005 in WOP.No.16 of 1999 on the file of the Ld I Additional Subordinate Judge, Salem For Appellant(s): Mr.P.Tamilavel ORDER The petitioners are the legal heirs of the second defendant, one K.Manickam in W.O.P.No.16 of 1999 before the I Additional Subordinate Judge, Salem. The petitioners as legal representatives of the said K.Manickam are seeking permission to accept the cause title since the second defendant K.Manickam is no more and it has become necessary for the petitioners as his legal heirs to protect their interest in R.E.P.No.307 of 2005. https://www.mhc.tn.gov.in/judis

2. Though it is contended by the petitioners that the first respondent has not taken any steps to implead the legal representatives, namely, the petitioners, who are the respondents in R.E.P., subsequent to the demise of K.Manickam and they have also enclosed the death certificate and legal heir certificate of the said K.Manickam, I am unable to see how Wakf Board can be blamed for non impleadment of the legal representatives when the death of K.Manickam, was not even brought to the notice of the Tribunal. 3. However, admittedly the petitioners as the legal heirs, who are the legal representatives of the deceased K.Manickam are entitled to step into the shoes and continue the proceedings including defending R.E.P. No.307 of 2005.
Hence the application to accept the cause title is ordered. No prejudice should be caused to the first respondent, Wakf Board if the legal representatives are permitted to canvass their grievances on account of the death of the original second defendant K.Manickam. 23-07-2026 VCA Note : Registry is directed to carry out necessary amendment and post it in due course.
