Mr. Prakash Chandra, learned counsel for the Applicant.
2. Present C528 application is filed by the applicant for direction to the 1st Judicial Magistrate, Roorkee, District Haridwar to decide the Complaint Case No.1311 of 2024 Indira Sharma vs. Kuldeep Bhardwaj under Section 138 of Negotiable Instrument Act, P.S. Kotwali Manglaur, Haridwar as expeditiously as possible preferably within a period of two months or within the time frame stipulated by this Court.
3. The matter relates to dishonour of cheques regarding payment of rent.
4. On perusal of the order sheet it reveals that the accused/respondent is unnecessary delaying the proceeding and due to dilatory tactics adopted by respondent, the case could not be concluded yet. It is stated that around two years have been lapsed from the date of filing the complaint but still the same is pending.
5. Learned counsel for the applicant made a prayer that direction may be given to the court below to expedite the proceedings of the Complaint Case No.1311 of 2024 Indira Sharma vs. Kuldeep Bhardwaj.
6. The instant C528 Application is allowed with direction to the 1st Judicial Magistrate, Roorkee, District Haridwar to hear and conclude the Complaint Case No.1311 of 2024 expeditiously.
7. It is provided that the court concerned shall not grant unnecessary adjournment to either of the parties.
