The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 for granting of pre-arrest bail in connection with Crime No.18 of 2026 of Dornala Police Station, Markapuram, was registered for the alleged offence punishable under Section 103(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’). 2. Mr.Rosedar S.R.A, the learned counsel for the Petitioners, submits that the Petitioners are innocent of the alleged offence and they have been falsely implicated by the Police. It is further submitted that the Petitioners are the sole earning members of the family and, therefore, their incarceration would cause undue hardship to their dependents. The Petitioners undertake to strictly adhere to any conditions that may be imposed by this Court. Hence, it is urged to allow the Criminal Petition. 3. Per contra, Mr.P.Akhila Naidu, the learned Assistant Public Prosecutor, vehemently opposed the grant of pre-arrest bail to the Petitioners, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the Petitioners are released on anticipatory bail, there is a strong likelihood that he may abscond, thereby

hampering the ongoing investigation and evading the process of law. Hence, it is urged to dismiss the Criminal Petition. 4. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 5. On perusal of the record, it is seen that all the accused are relatives.
The preliminary charge sheet was filed stating that Accused Nos.7, 11 and 12, who are the Petitioners herein, were merely present at the time of the alleged offence. This Court, in Crl.P.No.3792 of 2026 dated 08.05.2026, granted pre‑arrest bail to Accused No.4. There are case and counter‑case vide Crime Nos.18 and 19 of 2026. The names of the Petitioners are also not mentioned in the FIR. Accused No.4 was initially attacked by the deceased, and the deceased was killed by a shot of an arrow from a bow. The prosecution submits that the case was not established against Accused Nos.1 to 3. 6. Accused Nos.6, 8, 9 and 10 were granted default bail by the learned Trial Court, as they are all women. The Petitioners herein are also women and are housewives. There are no similar adverse antecedents reported against the Petitioners. 7. Having regard to the facts and circumstances of the case, the gravity and nature of the allegations leveled against the Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12, this Court is inclined to grant pre-arrest bail to the Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12, with some stringent conditions. 4
8. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of their arrest, the Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall be enlarged on bail subject to them executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall make themselves available for investigation as and when required; iii. The Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall not cause any threat, inducement or promise to the prosecution witnesses; iv.
The Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall not leave the limits of the Andhra Pradesh without the express permission from the Station House Officer concerned. 5
vi. The Petitioner Nos.1 to 3/Accused Nos.7, 11 & 12 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. _______________________ DR.
