The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That, petitioner most respectfully prayed that this Hon'ble Court may kindly be pleased to issue a writ of Mandamus and Quash the transfer order dated 29.01.2026 in so far as it relates to the petitioner (Serial No. 7) (Annexure P/1) and declare the same ineffective against the petitioner. 2 10.3 That, Direct the respondents to allow the petitioner to continue at her present place of posting till completion of the normal tenure. 10.4 Any other relief or reliefs that may be deemed fit and proper in the facts and circumstances of the case may kindly be granted also. 10.5 Cost of the case may also be granted.” 2. Learned counsel for the petitioner submits that the petitioner who is holding the post of Patwari is transferred vide order dated 29.01.2026 (Annexure P/1) from Patwari Halka No. 6, Pipartarai, Tehsil – Kota, Bilaspur to Patwari Halka No. 11, Tendua, Tehsil – Kota, District - Bilaspur. It is contention of the counsel for petitioner that the husband of the petitioner is a heart patient and she is also suffering with certain disease for which, she is taking treatment from Life Care Hospital, Bilaspur. Petitioner had already submitted representation before the Respondent No. 3 and therefore, direction be issued to the Respondent No. 3 to take decision on the representation at the earliest within specified time frame. He submits that as of now, the post of Sub-Divisional Officer (Revenue) is vacant and therefore, petitioner be permitted to submit representation before the Respondent No. 2 and direction be issued to the Respondent No. 2 to take decision on the representation at the earliest within specified time frame. 3. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to submit representation before the Respondent No. 2, he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised 3 by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit fresh representation before the Respondent No. 2 and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 03 weeks from the date of receipt of representation. 6.
