Mr. Prem Kaushal, learned counsel for the petitioner. 2. Mr. Himanshu Sain and Ms. Meenakshi Sharma, learned AGA for the State. 3. By the instant petition, petitioner is praying for the following relief: “i. Issue a writ, order or direction in the nature of Mandamus directing the respondent authorities, particularly, respondent no. 2 to transfer the petitioner from Sampuranand Shivir / Central Jail, Sitarganj, Udham Singh Nagar to Sub-Jail, Haldwani in view of the provisions contained under sub-Rule (i) and (iii) of the Rule 314 of the Uttarakhand Jail Manual Rules, 2023.” 4. On the previous date, the State was directed to get instructions from the Jail Authorities. 5. Today, learned AGA, on instructions apprised to this Court that neither the petitioner nor his family members have made any request for shifting of petitioner from one jail to another. He submits that complete procedure has been prescribed under Rule 316 and 317 of Chapter X of the Uttarakhand Jail Manual Rules, 2023. 6. Admittedly, neither the petitioner nor his family members have made any request for shifting of petitioner from one jail to another. Accordingly, the instant petition is disposed of with liberty to the petitioner or his family members to move a proper application for shifting of the petitioner from one jail to another jail and if such an application is moved, the concerned Authority shall decide 2026:UHC:3471 the same strictly, as per the procedure as laid down under Chapter X of the Uttarakhand Jail Manual.
