K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 17.03.2026 01. 1. Heard learned counsels for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Puri Town P.S. Case No.709 of 2025 corresponding to G.R. Case No.1633 of 2025 pending in the file of learned S.D.J.M., Puri on the grounds stated therein. 3. Perused the F.I.R. as at Annexure-1. The petitioners claimed to have no other similar antecedents. The details of the incident are narrated in the F.I.R. It has been alleged therein that the informant was assaulted by the petitioners. It is, however, claimed that there is no serious injury caused to the informant. Learned counsel for the State produced the case diary and medical examination report of the informant and it reveals that he received abrasions which are simple in nature with an opinion therein that it might have been caused hard and p. 2 blunt object. Since there is a counter F.I.R. lodged leading to registration of Puri Town P.S. Case No.710 of 2025 dated 17th December, 2025 in respect of the self-same incident and absence of any such grievous injury caused to the informant and recording the plea that none of the petitioners are having any antecedent, this Court is inclined to direct their release upon surrender before the learned court below instead of accepting the plea for pre-arrest bail as advanced by them. 4. Accordingly, it is ordered. 5. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned S.D.J.M., Puri within a fortnight from today, the petitioners shall be released on bail in connection with Puri Town P.S. Case No.709 of 2025 corresponding to G.R. Case No.1633 of 2025 subject to them furnishing bail bonds of Rs.25,000/- (Rupees twenty-five thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. Apart from the above, this Court directs that the release of the petitioners shall be subject to verification and absence of similar criminal antecedents. 6. Issue urgent certified copy as per rules.
